Breath, Blood & Urine Tests

They say I failed my breath test, but that's impossible. How do I prove they are wrong?

How to Challenge a Breath Test in Tennessee

With the Help of Memphis DUI Lawyer Paul E. Lewis

"Breath test technology is notoriously unreliable. In fact, some counties in Tennessee are no longer using breath test equipment because so many cases have been successfully challenged. I have invested time, travel and education to become a certified breath test operator and make sure I can mount an effective legal challenge to breath test and blood test evidence for my clients charged with DUI." — Paul E. Lewis

Breath tests and blood tests are often faulty, either because of improper administration, untrained operators and evaluators, defective machinery or faulty calibration. An experienced and knowledgeable DUI defense attorney should have the training and skill to challenge a breath test or blood test on both a legal and scientific basis.

Paul E. Lewis is a licensed phlebotomist and instructor in the proper use and calibration of the Intoximeter EC/IR2, the only breathalyzer machine used in Tennessee. He is certified by the National College for DUI Defense for his mastery of scientific evidence in DWI/DUI cases. Contact Mr. Lewis today to discuss how a legal challenge to breath test evidence could work in your case.

If you are arrested on suspicion of driving under the influence of alcohol or drugs in some western Tennessee counties, the police officers will take you to a local hospital for a blood test to determine your BAC (blood alcohol content) or to detect the presence of other substances in your system.

Hospital protocol and police procedure are often at odds in these cases. Hospitals often use an alcohol swab prior to drawing blood, thus contaminating the test. Hospitals also use an enzymatic process to determine BAC, whereas police crime labs use the gas chromatography method. Different methods in testing cause different numbered results.

Even without the all-too-common operator error, it is relatively easy for a qualified and experienced DUI defense specialist to mount a successful legal challenge to breath test and blood test evidence. Contact the Law Office of Paul E. Lewis today to learn more in a free consultation.
