The penalties for a conviction for drunk driving in Tennessee are very serious and are largely determined by the number of convictions on your record and by any aggravating factors such as tests showing that your blood alcohol content (BAC) was 0.20 or higher, well in excess of the 0.08 limit. Every conviction includes loss of driver's license and prison time. The following is a basic breakdown of the DUI penalties in Tennessee:
- First offense: 48 hours to 1 year in jail, 1 year probation, $350 to $1,500 fine and 1 year license revocation (may be eligible for a restricted license)
- Second offense: 45 days to 1 year in jail, 1 year probation, $600 to $3,500 fine and 2 years revoked license
- Third offense: 120 days to 1 year in jail, 1 year probation, $1,100 to $10,000 fine and license revoked for 3 to 10 years
- Fourth offense: 150 days to 6 years in jail, 1 to 6 year probation, $3,000 to $10,000 fine and a minimum of 5 years without a driver's license
The police are authorized to impound your vehicle if you are arrested and have any previous DUI on your record. The court may also order that an ignition interlock device be installed in your vehicle.
